What Happens when a Delivery Driver is Injured or Killed?

What happens when a delivery driver is injured or killed? Can a workers' compensation attorney pursue claims against an employer for a motor vehicle accident involving a delivery driver? Among delivery drivers, couriers and those who work in food service were at greatest risk of suffering a fatal accident. Injured delivery drivers and the survivors of delivery drivers who are injured or killed can file claims for compensation for their expenses and the pain and suffering they incur.

Nationwide, roughly 3.3 million individuals work as delivery drivers and many operate as part of large fleets. In total, delivery drivers represent approximately 2% of workers in the US, but this is an inherently dangerous profession. From 2003 to 2008, researchers recorded 5,568 deaths among delivery drivers. From 2003 to 2008, the industry recorded an annual average of 27.5 fatalities per 100,000 workers, which represented nearly 17% of all workplace fatalities during that period. Of these fatal accidents, 85% were the result of motor vehicle accidents; this dropped slightly to 81% in 2012. The remaining fatalities were caused by slip and fall accidents, exposure to weather or toxic substances, crushing injuries, or overexertion.

The risks of fatal delivery driver injuries rise with age. Those at greatest risk were between the ages of 45-54. Men are more likely to be involved in a fatal accident. From 2003 to 2008, men experienced 5,362 fatalities while women experienced only 206. As of 2012, the rates of injuries and deaths among delivery drivers remain higher than those of any other profession.

A workers' compensation attorney can pursue claims against an employer whose negligence places a delivery driver in danger. For example, workers can pursue claims for injuries or fatalities caused by not maintaining loading docks, failing to maintain a fleet vehicle, failing to properly train an employee, improperly loading a vehicle, or requiring a worker to drive in unsafe driving conditions. Employers are liable for work-related activities, including deliveries the driver is required to make, travel to/from delivery locations, and running errands on behalf of the employer.
