How Dangerous is it to Drive at Excessive Speeds?

How dangerous is it to drive at excessive speeds? How often is speed a contributing factor in personal injury and wrongful death auto accidents? At higher speeds, motorists have less time to react to other motorists, pedestrians, or obstructions in the roadway. Speed is one of the most common contributing factors to a motor vehicle accident. It is an aggressive driving behavior that is within the driver's ability to control. In Kansas, motorists can be held liable for accidents, injuries, and fatalities that occur when they choose to drive beyond the posted speed limits or prevailing road conditions.

In 2016, the National Highway Traffic Safety Administration (NHTSA) estimated that speed contributed to the deaths of 10,111 people. This was approximately 27% of all motor vehicle fatalities recorded in 2016. That same year, 1,368 speeding drivers in Kansas were involved in 1,368 injury accidents and 65 fatal accidents. In total, more than 4,524 accidents in Kansas were caused by speeding that year.

The Kansas Highway Patrol estimates that a motorist's risk of death doubles for every 10 MPH after 50 MPH. This means that the risk is greatest on the state's highways and turnpikes where speeding is more common and speed limits range between 50-75 MPH. At higher speeds, motorists are at greater risk of losing control over their vehicle. Greater speeds mean that the vehicle requires greater distances to come to a complete stop. Speed can also diminish the effectiveness of the vehicle's protective features. Seat belts, airbags, roll cages, etc. can fail at higher speeds. Finally, when a motorist is speeding they exponentially increase the risk of suffering severe injuries in a motor vehicle accident.

Drivers in Kansas can be charged with reckless driving when the responding officer believes the driver's behavior contributed to causing a motor vehicle accident. Law enforcement officers in Kansas have broad discretion in this regard. The law allows officers to cite motorists for reckless driving when they drive too fast for road conditions, drive in excess of posted speed limits, or otherwise operate the vehicle at a speed where it is not prudent or safe.
