Can convicted felons obtain a Commercial Drivers' License? Does a felon with a CDL pose a greater risk to motorists than a driver with a clean criminal record? These questions are being asked by legislators and lobbyists. They are eager to find answers that could resolve the expected shortage of 175,000 truck drivers expected in the United States by 2024. By hiring convicted felons, lobbyists argue it will fill the gap and create viable employment for felons. It remains unknown whether or not this will increase the risk of truck accidents to motorists and pedestrians.

Prohibitive Felony Convictions

At the Federal level, many felonies disqualify a driver from obtaining a CDL. These include manslaughter with a motor vehicle, operating a motor vehicle with a BAC of .08% or more, and using a motor vehicle during the commission of a felony. Other disqualifying felony convictions include extortion, bribery, kidnapping, assault with intent to kill, smuggling, and treason.

Driving with a Suspended CDL in Kansas

CDL holders with a suspended CDL are prohibited from operating a commercial vehicle in Kansas. However, they may obtain a restricted license to operate a passenger vehicle. This includes instances involving alcohol related and failure to comply offenses.

Felony Recidivism Rates

In May 2018, the Department of Justice published data that showed 5 out of 6 state prisoners were arrested at least once within 9 years following release. This study examined 401,288 state prisoners released in 2005. From 2005 through 2014, these former prisoners amassed a total of more than 1,994,000 arrests. This represented a rate of nearly five arrests per prisoner.

A total of 79% were rearrested within 6 years, and 83% were rearrested within 9 years. The recidivism rate is greatest in the first year following release and steadily decreases through the ninth year. Should legislative or regulatory changes allow for the hiring of certain convicted felons, these changes could very well place motorists and pedestrians at significant risk of personal injury or wrongful death.
