How much is my car wreck accident really worth? Many personal injury victims destroy their case because they are afraid to incur medical bills and do not go to a hospital.

- You give a statement to the other side’s insurance carrier and to your insurance company before getting the advice of legal counsel;
- You go to a chiropractor instead of a medical doctor;
- You go to a lawyer or attorney that is not an experienced personal injury lawyer that only occasionally handles motor vehicle accidents who lets you go to a chiropractor;
- You wait too long to call a real personal injury lawyer;
- You build gaps of time between the accident and later medical appointments making it appear that you were not hurt from the motor vehicle accident;
- You go to medical care and then refuse the recommended course of treatment;
- You talk to others about your case;

Now, turning our attention to what you need to understand about your personal injury case and your case evaluation you must understand that the case value of your bodily injury claim depends on whether you followed the first 13 rules. It depends on how bad you are injured. It depends on what hospital you go to. It depends on how bad you are hurt and what the doctors find wrong with you. Your case can be worth nothing to more than a million dollars. You do not want to be the million dollar case because that means you are crippled, paralyzed, dead, in a coma, amputated or otherwise severely injured. Kansas is a conservative state and many jurors here don’t believe in giving large amounts for pain and suffering.
Another important factor in how much your case is worth is the level of injuries compared to the level of available insurance. Many bad drivers carry small insurance or none. Then you have to turn to your own uninsured motorist coverage or underinsured motorist coverage. Thus, you should always carry a minimum of $250,000.00 per person and $500,000.00 per accident and one million dollar coverage is better.
You need to realize that if you get hit by a normal person driving a personal car then it is different than being hit by a semi, tractor-trailer, fleet vehicle or other commercial motor vehicle that will be required to carry a million dollars of insurance.
Never speak to lay persons about who to go to for anything. You need an experienced attorney that knows the experienced doctors that are not quacks and that are not scared of lawyers or the court system. If you go to a doctor that is afraid of lawyers and the court system, you lose. They will not back you on a causation opinion and will refuse to testify on your behalf. Normal people don’t understand that 90 percent of the medical profession either helps the workers compensation defense side or feeds off the system so they never want to help an injured plaintiff. There are many good lawyers that know good doctors but the percentage of the total population is low.
When you are really injured and are going to local hospitals in Hutchinson, Liberal, Hays, Dodge City, Garden City, Salina, Colby, Emporia, Newton, McPherson, Arkansas City, Winfield, and other smaller cities, you will always get better medical care at a first level trauma hospitals known as tertiary care facilities. In Western Kansas that means Wesley Medical Center or Via Christi St. Francis. If you or a loved one is hurt ask for an ambulance transfer or Eagle Med air ambulance transfer. It may make the difference on your final result.
Your case value also depends on the level of experience and skill of your retained lawyer or attorney. If you hire an attorney that has never handled any trucking accidents it is likely that they will not know what to do. These cases are labor intensive and you have to understand the Federal Motor Carrier Safety Regulations. I wrote the book called Truck Accidents Kill! It teaches a lawyer or safety person how to look at the FMCSR regulations issued by the DOT. You need an experienced attorney whenever you have a tractor-trailer or semi accident case. If you have a trucking or tractor-trailer case and the lawyer is not taking a deposition of the truck driver and the safety director as well as other management in the trucking company then it is difficult to get a truly adequate recovery since the necessary deposition discovery never gets taken. The lawyer has to study these regulations for years to have an adequate comprehension of them.
At this point, you can obviously see why hiring a truly experienced trial attorney is necessary. Most cases settle after the deposition phase and do not have to go to trial. The cases that have to go to trial are usually those cases that have bad facts or large pre-existing degenerative conditions with a causation problem. Many lawyers are good lawyers that have experience in very limited areas of the law. You need a lawyer who concentrates their practice in trial practice and regulatory interpretation whenever you have a trucking case.
